What this regulation requires

Where a facility is unable to meet the licensed nurse and registered nurse coverage requirements, a State may waive them if the facility demonstrates it has been unable, despite diligent efforts including offering wages at the community prevailing rate, to recruit appropriate personnel; the State determines the waiver will not endanger the health or safety of residents; and a registered nurse or physician is obligated to respond immediately to telephone calls during any period when licensed nursing services are unavailable. A waiver is subject to annual State review.
